If it is listed under NEW it should come in the box. The box is exposed for this item so you can touch the dinosaur but that is the way Hasbro package them. It can't really be classed as NEW unless it comes with the box so you should be ok. You are entitled to return the item if the seller if you are not satisfied.

Is the toy supposed to make noise whilst in the packaging?

It needs batteries putting in it anyway so shouldn't be making a noise in the box
