I used to own a new 3ds xl and bought some games digitally. if i buy the new 2ds xl can I download those games from the store without paying again?

All 3DS/2DS systems require transferring the digital game license to a different 3DS/2DS by way of a system transfer. In short, the digital games are tied to the physical 3DS/2DS, not to the Nintendo Network ID.
